Tata Motors has always held a good position in the Indian automotive industry. This time around the brand has been penalized by Panchkula's, district consumer disputes redressal forum, that has directed Tata Motors and its dealer Banarsi Dass Automobiles Ltd, Industrial Area Phase 2, Panchkula to pay Rs. 7.55 lakh to a Zirakpur resident Amit Thaman who has been handed out a defective Tata Manza Aura.

As per the complainant, he had purchased a Tata Manza Aura from Banarsi Dass Automobile Ltd for Rs. 6.5 lakh back in 2011. Thaman said that the vehicle faced ‘missing and pick up problems’ after driving it for about 6,700 kms. Post addressing the issue to dealer and Tata Motors Limited, the problem was claimed to be rectified by replacing the assembly intercooler. But the problem again resurfaced after 5-6 months, during this time, the complainant reportedly replaced turbo compressor, vacuum accumulator, vacuum pump on alternator and turbo charger of the engine. The car went for about 16,000 kms and then again faced similar issues. Even though the car went for repairs numerous times, the problem persisted.

In defense to the complaint received by the forum, Tata Motors and its dealer said that the complainant did not follow the recommended service intervals and they had replaced all the components that required replacements. The forum intended on getting the car inspected by director-principal, Punjab Engineering and University of Technology (PEC), but this was rejected by Tata Motors Limited and its dealer, they instead wanted to get the vehicle examined by M/s Joshi Automobile Pvt Ltd, Panchkula. The forum allowed this but the complainant appealed against this before the state consumer disputes redressal commission, Haryana, which then directed Neeraj Ratti, a mechanical engineer, proprietor, Newage Automobiles, Panchkula, to examine the vehicle.

The report clearly stated that defects of the engine were inherent manufacturing defects. Going by the reports, the Forum has directed Banarsi Dass Automobile Ltd and Tata Motors Ltd to refund INR 6.5 lakh, the cost of the car> Additionally they are also required to pay INR 1 lakh as compensation for causing mental agony and harassment, besides Rs. 5,000 as the cost of litigation.
